Check corporate-name availability and brand rights separately before spending on branding.

Company-name approval and trademark protection are different processes. A name being available as a domain or corporate filing does not establish that it is safe to use as a brand. Search relevant existing marks, names and similar wording before commissioning signage, packaging or a major website. [1] [2]

Build a meaningful shortlist

Describe the proposed business and any regulated or sensitive words. Check identical and similar corporate names, then examine relevant trademark classes, phonetic similarities and existing market use. Record the searches and dates; one exact-word result is not a complete clearance exercise.

Plan the filing and ownership

Decide which entity or person should own a trademark application and whether a word mark, device mark or both need consideration. Keep name-reservation approval separate from incorporation and trademark status. Where a name needs consent or authorisation, collect it before submission. [1] [2]

Practical preparation checklist

  • Proposed names and a description of activities.
  • Corporate-name, trademark and practical market searches.
  • Ownership/consent evidence where applicable.
  • Brand-spend decision after an appropriate risk review.

Illustrative example

A founder finds an available domain and assumes the same wording is legally cleared. A similar registered mark may still exist for related services. Discovering that before printing stationery is less disruptive than changing the brand after launch.

Avoid this mistake

Do not label an automated search “trademark guaranteed.” Opposition, examination and third-party rights are separate risks. A professional search opinion should state its scope and limitations rather than equate an empty exact-match list with a guaranteed registration.
